JULY 2017 VISA BULLETIN: ANALYSIS AND PREDICTIONS

The Department of State has just issued the June 2017 Visa Bulletin.  This is the ninth Visa Bulletin of Fiscal Year 2017.  This blog post analyzes this month's Visa Bulletin.

MU Law Analysis

All Other:  The EB-2 has been current for many years.  The EB-3 progression continues to be effectively current.

China (mainland-born):   The DOS instituted a retrogression for China EB-1 with the June Visa Bulletin.  The continued high level of demand for EB-1 numbers for USCIS adjustment of status applicants has required the establishment of a date for June. It is expected that this EB-1 retrogression will last until October 2017. 


The China EB-2 date again moved up, but only a few weeks.  The DOS notes that there has been an extremely large increase in EB-3s during the past month. The China EB-3 date retrogressed.  It is now slower than China EB-2. This was predicted last month.

India:  As with China, India EB-1 now is retrogressed.  It is expected that this EB-1 retrogression will last until October 2017. 

EB-2 India moved up about two weeks.  EB-3 India jumped into 2006, which is a pleasant surprise.  It is not what we expected.  The DOS is clearly trying to ensure that all visa numbers are used in FY2016. 

Mexico: Mirrors All Other in all aspects.

Philippines: EB-3 moved ahead one full year!  The Philippine EB-3 number essentially cleaned out all of the 2010, 2011, 2012, 2013, and half of 2014 EB-3 visas in about 7 months.  This is even more positive than we expected.  (Our note from September 2016"This is consistent with internal MU Law analysis which sees this category progressing into 2013 by the Summer of 2017.").  

Our internal metrics see the Philippine EB-3 number continuing to progress at a rapid clip for the rest of 2017.

    Hi! This EB-3 Philippines jump is even better! I will be current by next month.

    What is the average time now from being current up to receiving the green card in the mail?
    Is it still 2-4 months? Or is USCIS backed up at this time? My friend filed I-485 last November and was told the the card might arrive by next month or on August. That's a pretty long wait.

    1. Hi Concerned,

      Yes - Great news! If you are in the US, it take about 4-8 months from the filing of the I-485 until the receipt of the GC. However, we often see the processing time speed up in Aug/Sept because the government wants to make sure that the GC is issued in the correct fiscal year.

  7. No more US green card for me or my family. Waited as a Physical Therapist on EB-2 India since July 2009. Moving to Canada as permanent resident in 2 months

    1. Hi Simon, I'm sorry to hear that. America is worse for the long retrogression for Indian natives. You can of course move to Canada and maintain the US GC if your employer will allow it.

  10. Good day MU!

    I would just like to inquire regarding my case. My priority date is May 21, 2014 under EB3 Philippines. Based from the Dates for Filing of Employment-Based Visa Applications Chart, the application date was July 1, 2014. Do I have to receive first an email from NVC or from my employer instructing me to submit documents or to start completing DS-261/260?

    1. If i may, you only use dates for filing chart if DoS says so. Otherwise, final action dates chart will be used.

    2. Overseas applicants should essentially ignore the DOF chart and only rely on the Final Action chart. The DOF chart if for the NVC.

  11. Hi MU,

    Good day! My PD of 5/8/14 EB3PH is finally current this VB. I completed my DS260 last sept 2015 when they were still accepting documents even though EB3 PH retrogressed. Do you think I would need to submit a new DS260 before they schedule me for the embassy interview? Also, how long after the PD becomes current do they schedule the interview?

    1. Hi Nero, No - you do not need to resubmit to the NVC. The embassy should set up your interview shortly.

    1. Hi Dell, If you are lawfully in the US, then you can file an I-485 when the DOF chart is current for your category.

  18. I have eb3 philippines with pd of march 12,2015. Based on DOF, can I file for the AOS now since I'm here in the US with status?
