CHECKING IN ON THE VISA BULLETIN

The Department of State’s Visa Bulletin guru, Charlie Oppenheim, hosts monthly meetings with the American Immigration Lawyers Association.  Charlie Oppenheim is the Department of State’s Chief of the Control and Reporting Division. He is the officer who is responsible for producing the Visa Bulletin each month.

This month’s Check In With Charlie featured predictions about EB2 and EB3, which are the most popular categories for readers of this Blog.  Here are some of this month’s highlights:

EB-3 Worldwide.  Charlie expects EB-3 Worldwide to continue to be “effectively current” for the foreseeable future.

EB-3 India. Charlie predicts that the July final action date for EB-3 India will advance to October 15, 2005, which he reiterated at a May 18, 2017 meeting with AILA in Washington, D.C.

EB-2 India. Previously, Charlie believed that this category will recover to FY2017’s final action date.  Unfortunately, he no longer believes this to be the case.  This category may retrogress or exhaust in August, until October 1, 2017.

EB-3 Philippines.  Charlie did not comment on EB-3 Philippines, but MU Law’s internal tracking indicates that this category will continue to progress at the same rate as the last few months.

  1. Does it mean that EB3 for Phil will possibly reach 2015-2016 by next year? Or do you think EB3 for Phil will slow down, stop or retrogress in the coming months?

    1. I think he just said that eb3 phils will "progress at the same rate as the last few months"

    2. @Nurse khaleesi - eya is correct. I see the EB3 Phils moving at a 3-4 month or so rate through the 2013-2014 fiscal years. My sense is that the rate may slow as we progress into 2015.

    I have my USICS case No. but I do not know the priority date. I also do not have my case receipt copy or approved copy. how can I find my priority date.

    2. Thanks . Considering the uncertainty of Trumps presidency due to Flynn, kushner drama, do nothing congress, if no bill is passed, will it be 2022- 5 years from now? Or my best bet is move to Canada as PR which I have now and leave my job, sell house. I hope lawmakers understand what I am going through- they don't have to deal with my issues- BTW- I am a PT in a hospital. The dumb lawmakers want to increase the salary to $1,30,000- which even an American PT won't make- just they are out of touch with reality

    3. The increased salary requirement is for employers to not offer it to citizens first. Meaning, if you earn at least $130,000, your employer is not required to publish about that opening. Now, if you earn less than that, the employer is required to publish that there is an opening for that certain position for them to get passed the dept of labor requirements, thus, offering the position to citizens first.

    4. my point is not ALL professions make $130000- so why bother creating confusion among gullible US voters- so far it's all talk and no action about building wall, cracking down on outsourcing companies and immigration reform

  4. Hi, I had a pending I-140 which was long current september 2009, but hasn't responded to it. tried checking the case status of my lin number in uscis. gov but it says that its no longer existing? will it be automatically invalid for a certain period of time? cheers

    1. Hi RK - It is really hard to predict that far down the road. Having said that, my hunch is that July09 will be current by 2022.

  8. US citizens are not granted with any sort of visa exemption. For detailed Vietnam visa information US citizens can enquire with Vietnamese Embassy, located in Washington DC. check here

  9. The fact is that hiring an immigration attorney is a matter of preference. As an immigration attorney myself, I can safely say that some immigration matters probably do not need the attention of an immigration attorney.kurzfeld
