USCIS COMPLETES DATA ENTRY OF H-1B CAP PETITIONS

USCIS has just announced that it has completed data entry of all fiscal year 2018 H-1B cap-subject petitions selected in their computer-generated random process.  It may take a week or so for all of the H-1B cap receipts to be delivered.  If a Beneficiary has not received an H-1B receipt notice in the next week or so, it stands to reason that they have not “won” the H-1B lottery.

Shortly, USCIS will begin returning all H-1B cap-subject petitions that were not selected.  USCIS is unable to provide a definite time frame for returning these petitions.  USCIS will issue an announcement once all of the unselected petitions have been returned.

In order to balance the distribution of H-1B cap cases, USCIS is transferring some Form I-129 H-1B cap subject petitions from the Vermont Service Center to the California Service Center.

  2. My H1 B transfer application was filed on April 14th and I am yet to receive my receipt number. I was told that this delay in receiving receipt number is usual during this time of year and it might take 2 more weeks before I receive a receipt number.
    Is this right? Is it safe to continue with transfer process given the delays?

    1. We are also seeing delays on the receipts. Has your attorney checked to see if the filing fee check was cashed and/or the courier delivered the package to the Service Center?

    2. Yes, the check has been cashed. I am told in the next two weeks we would receive the receipt.

      Also, how many weeks can one take off before starting with new company/ job?

  3. Theoretically you can wait until the H-1B transfer is approved. Having said that it is probably best if you check with your attorney about your specific situation.
