MU Law Analysis

All Other:  The EB-2 has been current for many years.  The EB-3 is also current and is expected to remain current for the foreseeable future.

China (mainland-born):  Both China EB-2 and EB-3 progressed about one month.  The China EB-3 remains more favorable than Chinese EB-2.  The odd situation of China EB-3 progressing faster than China EB-2 will remain to be the case for the foreseeable future.

India:  India EB-2 progressed about one month, which is what we except the monthly progressions will be in FY 2018.  Unfortunately, India EB-3 did not move.  Recently, the DOS said that EB-3's progression will be "limited."  MU suspects that EB-3 will not progress at any notable rate until at least the India EB-3 date moves past the Visa Gate date of August 2007.

Mexico: Mirrors All Other in analysis.

Philippines: The Philippine EB-3 date stayed in January 2016, reflecting the fact that demand for the Philippine EB-3s recommenced heavy demand in 2016.  This increased demand will be the cause for slower progressions in the FY2018, progressing no more than 1-2 months per Visa Bulletin.

  1. Chris,

My question 2 months ago about when my Priority date - August 24,2009 -EB-2 India will be current- your opinion was may be October 2018. There are 10000 EB-2 cases between November 2008 and November 2009. With only 2800 allocated for EB-2 India- do you think October 2018 is unrealistic and may be 2022 October is the probable answer?. It’s judt depressing even to wait that long after entering US in 2007. Please advise. Thanks for your time

    1. I agree - Oct 2018 may be optimistic. Having said that my sense is that some of the 10,000 have given up and will not take their visa when the number comes up.

    1. Once your I-140 is approved, if you have a current priority date, it will be 4-6 months until your interview.

    2. Hi Cyanotica,

Im a little bit worried because I too didnt receive my I-140 approval yet. It was received by Nebraska Processing Center last June 2017 but no progress. I have monitored their processing priority cases, they're still at December 2016. I know someone who processed at Texas Service Center at the same time as mine, but he got his approvL notice in just 2 months. May i know what service center you are?

    3. Hi mark, my service center is in texas. They received my notice last march, they asked for RFE and until now they dont have any response. Its been 8 months, but my agency said that the approval takes about 3-9 months and sometimes longer. But im worried too.

    4. Hi Cyanotica, wow. Thats a long time. I heard Texas is the fastest. While mine, Nebraska tends to be slower than any service center there is. Or it really depends on each case. The thing is, there's nothing we can do much but wait, and pray for more and more patience. Good luck to us!
