DECEMBER 2012 VISA BULLETIN

The Department of State has just released the December 2012 Visa Bulletin.  

Overall, the news was disappointing.  India EB-2 remained at September 1, 2004.  MU Law expects the India EB-2 number to move forward, although we are surprised that the progression did not happen with this Visa Bulletin.  The Philippine EB-3 date was equally disappointing, progressing by only one week.

On the bright side, the All Other and Philippine EB-2 date remained Current.  We expect this number to remain Current or near Current until Spring/Summer 2013, when it should become unavailable as it does most Summers.

  1. Chris,what do you think is the reason why EB3 Phils. is moving so slow this past 3 months now. All of the other countries are advancing at the average of 1 month but it seems that EB3 Phils. was being left behind. Do you think it will continue all throughout the 2013 fiscal year? thanks!

  2. f I had to guess it is because there are an abundance of Phils EB3 cases in with PDs from 2006-07 because of the expiration of the EX visa, which prioritized RN and PTs. When the EX visa expired it left many petitions still in the queue.

It may be disappointing but on the brighter side, with the slow movement in the visa bulletin, we can sign a contract with other countries abroad that are typically 2-3 years in length, so the longer the better. You might even qualify for citizenship with such countries if the trend continues.

  5. is it possible to move from EB3 to EB2 if the Job description does not require it (Medical Technologist? though I have all the requirement to qualify for EB2
