AUGUST 2012 VISA BULLETIN


The Department of State has just released the August 2012 Visa Bulletin.

This Visa Bulletin contains no surprises. EB-2 China and India remain Unavailable and will remain Unavailable until the October 2012 Visa Bulletin, which is the first one of US Fiscal Year 2013. The conventional wisdom is that the EB-2 China and India dates will leap ahead, although how far ahead remains to be seen.

The EB-3 categories had their usual slow but steady progress in the August Bulletin, a pace that is expected to remain for the foreseeable future.

    Thank you for all of your information.
    Sen grassley lift his hold on HR3012 and it is not a good news for me. In the next visa bulletin i will be current .Do you think that with all the election program this bill has a chance to become a law before October 2012?

    do you think that this content is correct .It is my understanding of HR3012 .And i think if thisbill become a law the effect will be in October 2013 .
    Year 1 - 15% (6,006) reserved for Countries other than China and India (ROW, Mexico & Philippines) No Country can use more than 25% of these (1,502)
    Year 1 - 85% (34,034) for use by India & China. No Country can use more than 85% of these (28,929) so China will have a minimum of 5,105.

    Years 2 & 3 - 10% (4,004) reserved for Countries other than China and India (ROW, Mexico & Philippines) No Country can use more than 25% of these (1,001)
    Years 2 & 3 - 90% (36,036) for use by India & China. No Country can use more than 85% of these (30,631) so China will have a minimum of 5,405.

    China will quite quickly reach the same Cut Off Date as ROW etc. At that point ROW, Mexico, Philippines and China will share the combined number of available visas by PD, since China cannot have a PD later than the Worldwide one.

    Only Philippines are likely to reach the 25% limit of Reserved visas, but may use a disproportionate number of the the Unreserved visas that China eventually brings to the table because they have a huge demand where the Cut Off Dates have presently reached.

    Actually I am in search for the new employer who can sponsor my I-140 but haven't found yet. My interview at US counselor is at the end of July which is comming near, I cannot attain my visa interview without renewed Job offer letter. So can you please advise how to reschedule my interview date open for a year. In the website of the US embassy it is instructed that we have to write them, Do I have to give reason to reschedule the interview date? Should I say I am waiting for renewed job offer from my employer or should i say something else.
    Please give your valuable thoughts.

  5. @k.sh: There is a bi wildcard which is that no -one knows how many of the pending EB3 visas are no longer being pursued because they have either upgraded to EB2 and/or abandoned.

  6. @ Yatra: I would probably just answer "personal matter" and leave it at that. Keep in mind that if you find a new I-140 employer, you may be required to get a new visa appointment.
