OCTOBER 2020 VISA BULLETIN: EB-3 CURRENT FOR ALL BUT CHINA, INDIA

 

The Department of State has just issued the October 2020 Visa Bulletin. This is the first Visa Bulletin of Fiscal Year 2021. This blog post analyzes this month's Visa Bulletin.

Table B: Dates of Filing

The USCIS has just announced that it will allow the more favorable Date of Filing chart for I-485 Adjustment of Status. This means that all employment based immigrants in EB-1, EB-2 or EB-3 can file their I-485s starting October 1, 2020.  However if they are natives of India or China, their priority date must be earlier than these dates:

This was the Visa Bulletin that we have been expecting for some time.  Because of the State Department’s inability to issues immigrant visas for much of 2020, there are many, many immigrant visas that are now part of allocation for the new fiscal year. 

Both the Philippines and Worldwide (All Other) EB-3 have become current.  We expect these categories to stay current for the foreseeable future.  The only constraint to the Philippine EB-3 visas being issued is the capacity at the Embassy in Manila. 

The good news extended to India.  India EB-1, EB-2 and EB-3 all moved forward, about 3-5 months in all of these categories.  Similarly, China EB-1, EB-2 and EB-3 all moved forward at about the same rates as India.  We do not expect a retrogression in these categories.

    I'm DQ'd already with VS. since my PD is already current how long should i wait from DQ to visa issuance if the VB will remain current in the next couple of months. Thank you.

    1. The embassy will not close unless there is a COVID outbreak. The election will not change anything.

    2. but it seems like they are not basing it in DQ. there are some who received ID and there DQ date is just this year compared to those people whos been DQ 3 yrs ago still no ID received from embassy 😕

  11. Hi Atty, I am nurse by profession and I would like to pursue my immigrant application. My PD is March 2008 and the current status is for review since June 2018. Is there is possibility to recapture it? Thanks in advance for ur reply.

    1. You will need a US employer who is ready to hire you. You cannot continue with a case unless the I-140 sponsor still wants to hire you.

    I am under EB2 category and I’ve been DQ’d this June 2020. I’ve also received an expedite approval last July but until now I haven’t received an interview schedule yet. May I know what is the basis of the embassy in giving out interview schedules for EB2? Will it be in the same queue as the EB3? Thank you very much and more power!

    1. The Embassy has not released a basis for their interview schedules. Keep checking with them.

    It seems that the US embassy continues to issue 221g and worse those who were approved on the spot are shown refused on CEAC after a few days? quite devastating.Any thoughts on this? thank you
