MAY 2018 VISA BULLETIN: NEWS AND ANALYSIS

The Department of State has just issued the May 2018 Visa Bulletin.  This is the eighth Visa Bulletin of Fiscal Year 2018.  This blog post analyzes this month's Visa Bulletin.

MU Law Analysis (all references are to Table A unless noted)

All Other:  The EB-2 has been current for many years.  The EB-3 is also current and is expected to remain current for the foreseeable future.

China (mainland-born):  As with all categories this month, the movements were minor or nonexistent.  It would not surprise MU if the Chinese numbers stayed steady through the fiscal year.  China EB-2 is a better bet to progress than EB-3, although it remains doubtful that EB-2 progresses ahead of EB-3.

India:  India EB-3 had the most promising move of all EB categories, progressing from February to May 2008, which marks two consecutive months of great progress.  This likely reflects the fact that many older Indian EB-3s have either dropped out of the system or have upgraded to EB-2.  For a long time, MU Law has believed that India EB-3 would move much faster, once India EB-3 moved past 2007.

Mexico: Mirrors All Other in analysis.

Philippines: Phils EB-3 stayed steady, which is not surprising considering the enormous progressions of the last few years. The Phils EB-3 number will probably continue to only move slowly, reflecting the large numbers of Philippine RN EB-3 petitions that were filed in 2016-2018.

    I am scheduled for US embassy interview in the Philippines as an EB3 applicant on May 11.If it retrogress next month (June 2018 visa bulletin).Will I be affected by it?.Thanks for the response.

    2. Hi Ivstan: No - a June retrogression will not effect your interview or visa issuance. Also, I do not think that it will retrogress in June.

    3. RNjoan: Your priority date is set on the date that your I-140 is filed. If that date is, for example, April 14, 2018, then your green card interview is not allowed to take place until the Table A chart is at least April 14, 2018 for Phils EB-3 (if you are Phils EB3).

  3. Hi Chris Musillo

    With current EB3 India forward movement, and EB1 stalling at 2012, do you see a horizontal spillover from EB2 ROW to EB2 India or the spill over will be applied to EB1 India? Or from where will the spillover be for EB2 India

    My second question is August 28, 2009 is my PD. When will it be current?

      Re:#2 - Are you EB2? If so, I don't think until FY 2019, i.e. after Sept 2018.

      Given the current movement under EB-3 India, any chance of it moving into end of 2009 or early 2010 for FY-2018?

      My priority date is 02-2010 (EB-3 India)

    3. Yes, I am EB2 India. Sorry to ask again Chris. There is no more vertical spillover from EB1 to EB2 as EB1.

      Question 1–From which category will EB2 get the spillover?

      Question 2- roughly which month I will be current?

  7. Hi! what can be the basis of RFEs and denials of USCIS? I was re-filed premium last March 23 and received an RFE last Apr 16 notified by my agency. Is there a possibility of a second denial? (but still looking forward for a positive outcome) oh,Lord, please.

    1. Hi Frey. I am also on RFE. 1st time though. Still waiting for the letter stating for the reason. Do you know the reason for your 1st denial and the second RFE?

    2. The first denial was about re-wording the contract I signed with the agency. The second RFE, clueless. They just said, “it has become a more frequent practice in the USCIS”
