AUGUST 2017 VISA BULLETIN: ANALYSIS

The Department of State has just issued the August 2017 Visa Bulletin.  This is the eleventh Visa Bulletin of Fiscal Year 2017.  This blog post analyzes this month's Visa Bulletin.

MU Law Analysis

All Other:  The EB-2 has been current for many years.  The slight retrogression is temporary and will revert back to Current in October 2017.  The EB-3 progression has long been effectively current, and is, in fact, current in August.

China (mainland-born):   The DOS instituted a retrogression for China EB-1 with the June Visa Bulletin, which remains.  The continued high level of demand for EB-1 numbers for USCIS adjustment of status applicants has required the establishment of a date for June. It is expected that this EB-1 retrogression will last until October 2017. 


The China EB-2 date again moved up, by one month.  The DOS notes that there has been an extremely large increase in EB-3s during the past month. The China EB-3 date remains at January 2012, which is where it was in July.  It is now slower than China EB-2. 

India:  As with China, India EB-1 now is retrogressed.  It is expected that this EB-1 retrogression will last until October 2017. 


EB-2 India held steady.  EB-3 India jumped into 2006, last month, which was a pleasant surprise.  It moved up again, this time into mid-2006.  The DOS is clearly trying to ensure that all visa numbers are used in FY2016. 

Mexico: Mirrors All Other in all aspects.

Philippines: EB-3 moved ahead one full year!  This is the second straight one year progression.   The Philippine EB-3 number essentially cleaned out all of the 2010, 2011, 2012, 2013, 2014 and half of 2015 EB-3 visas in less than one year.  This is even more positive than we expected.  

Our internal metrics see the Philippine EB-3 number continuing to progress at a rapid clip for the rest of 2017.


The retrogression of the EB-2 (Phils) number is nothing to be concerned about.  It will return to Current in October 2017.  Note that all EB-2s retrogressed, which reflects heavier demand than usual in the entirety of the EB-2 category.

  5. Please don't say that. I'm putting ny hope so high now. :) Charlie said that this end of FY 2017 he is seeing a continuous movement for EB3 Philippines. Remember that?

    1. Sure - but the Phils EB3 will likely become unavailable sometime in late September for a few weeks. This will means that the full allotment of Phils EB3s would have been used in fiscal year 2017.

    1. I wouldn't read anything into the September VB. Having said that I suspect that you will have your visa appt in the next few months.

    My PD is June 26,2015. If in case I got approved with a visa, do you think I will make it in the US this year? And is there going to be a retrogression for Philippines Eb3. Thanks! And more power to you guys!

    My PD is Dec 2014. Do i need to recieved anything from the uscis before submitting the l485?. Do i need to submit it first week of august or any days in august? Thank you again for your help.

    1. Any day in August is fine, unless the USCIS retrogresses Phils EB3 (which is possible, but I don't think it will happen until Sept).

  14. Pdear MU law, my PD is SEPT 17,2015(eb3 phils) i received a letter from NVC asking me to pay the visa fee CC to my ATTY and employer.. question: 1. will i be current next month?
    2. My visascreen is still processing do you think i should pay the visa fee immediately? Is it a good idea to wait for my visascreen certificate? Please advice... thank you

    1. You should probably wait for your visa screen. Be sure to check with your employer and your attorney. Most times, you should have the attorney process the payment of the fee. You should not pay it directly.

  15. Hi MU. Just want to ask. How come some applicants received their fee bill even before their pd becomes current just like the comment above? My pd is already current and im still waiting for my fee bill from nvc. It has not been sent to my agency either

  17. Hi MU law, i am EB2 philippines and obtained my i-140 approval notice last friday. I then received this week my RFE for my adjustment of status (i had an existing eb3 application when it retrogressed in 2015). So i am completing all the requirements indicated in the RFE this week. Assuming no hiccups, when do you think ill receive my actual green card? Thank you!
