ANALYSIS OF THE DECEMBER 2015 VISA BULLETIN

The Department of State has just issued the December 2015 Visa Bulletin. Here 
is MU Law's analysis of this latest Visa Bulletin.

MU Law Analysis
All: No change from Nov 2015 Visa Bulletin, other than a one month improvement in EB-3.
China: EB-2 did not change. EB-3 progressed a few months from Nov 2015 Visa Bulletin, which was 01JAN12.
India: EB-2 jumped again. Two months ago it was 01MAY05. In Nov 2015's Visa Bulletin it was 01AUG06. This trend may continue. EB-3 continued its steady but slow progress.
Mexico: One month gain in EB-3.
Philippines: EB-3 moved ahead six weeks. MU Law believes that Philippines EB-3 will steadily move forward in the coming months.

MU Law Analysis

The Dates of Filing chart did not change from October or November 2015. This is not a surprise. The USCIS and Department of State have been sued in response to the September 2015 revised Visa Bulletin

  3. hi MU law!i have read the latest VB.and it seems that the movement of EB3phils is quite slow?what does it mean?.are they going to maintain that movement within this fiscal year?Please give us ur thoughts about this.thank you and more power!

    1. @Glimbert- I think that this slowdown is temporary and the Phils EB3 will move quickly in 2016.

  5. Hi , we are now in the USA ..we already have our EAD and recently we submitted our Rfe and did our medical for the 2nd time since the first one expired..we really wanted to get our green card hopefully no more delays .thanx

    1. Good luck! Your green cards should be in processing. There is a good chance that you have the new cards in December, provided that there are no additional RFEs or problems with your case. Since we are not your attorney, we cannot say for sure...

  7. One more question please, I just check the green card tracker , it says there is 1845 ahead of us with the consular process in line with the pending I-485 , that seems that 1845 will take a longer time, am I right ?thanx

  8. Hi Atty. Musillo I was looking at the waiting list of EB3 PH waiting for an immigrant visa, right now there are 28,000++ waiting for greencards under EB3 Philppines. Do you think this has an impact on the VB movement? They moved it so fast without considering that 28,000. Right now my AOS is pending for a year. Thanks

    1. Yes - the volume is why I think the "true" EB3 Phils PD is probably in 2012-13.

    2. That having been said, if your PD is current you should expect the GC in 30-90 days in the usual course.

  10. Hi Atty. Musillo we are a follow to join derivatives of my wife who adjusted status in the US with a PD of July 2007 EB3 Phils. We are finished with the interview in Manila Consulate last April 2015 but put on AP and consequently affected by retrogression last may 2015. Since our PD will be current by Dec 2015, can we submit to the consulate before Dec our new passport, new medcal and new NBI/ Police Clearance because all of them are already expired? The reason that I want to submit it earlier than Dec because my son will aged out by Jan 2016. Can we do this or we just wait for their notice/ email? Your advice will be highly appreciated.

Hi there Atty.You are our lawyer so Im just wondering when are we going to receive outr GC since the uscis already received our rfe's on July 28,2015?We already did our second medical exam which we submitted along with our rfe.Our PD is April 2007 by the way and we have our EAD since last year.Thank you and more power.

    3. It will still be quite awhile if you are EB3 Philippines with a Nov 2014 Priority date. My sense is 2017.
